NOTHRON - GLOBAL TERMS OF SERVICE AND USER AGREEMENT

Important Warning
This Agreement is a legally binding contract between Nothron ("Service", "We", "Us") and you ("User", "You").
By logging in with your Google account, using the Service, or clicking "Buy" in the confirmation window that opens when you start a credit purchase process and accepting the Terms of Service via checkbox, you declare that you have read, understood, and fully accepted these Terms. If you do not accept, stop using the Service immediately.
This Agreement is subject to the laws of the Republic of Turkey. These Terms apply in full except as required by applicable law. If any provision is invalid, the remaining provisions remain in effect.
1. LEGAL BINDING AND ACCEPTANCE
By logging in to the Service with your Google account or clicking "Buy" in the confirmation window that opens when you start a credit purchase process and explicitly accepting the Terms of Service via checkbox, you are deemed to have irrevocably accepted this Agreement.
This confirmation is explicit consent given in electronic form and is recorded in our database with date and timestamp. The user declares and commits that they are over 18 years of age and have full legal capacity to enter into this Agreement. Use by persons under 18 is strictly prohibited.
2. NATURE OF SERVICE, RIGHT OF WITHDRAWAL AND REFUND POLICY
Nothron is an instantly performed digital service offering AI-based photo enhancement, upscaling, restoration and neural transformation services.
When you access the Service or initiate any transaction (including credit purchase), you explicitly consent to the instant performance of digital content and accept that you waive your right of withdrawal under the Distance Contracts Regulation.
Refund Policy:
Once an enhancement or neural transformation process is initiated, the service is deemed fully performed. No refund, credit refund or compensation shall be made under any circumstances for any subjective reason such as aesthetic preference, subjective quality, AI output not meeting expectations, anatomical flaws, hallucinations or any other subjective reason.
No refund shall be given except as required by applicable law. In case of technical failure, investigation and exceptional credit refund is a discretionary right entirely at the discretion of the Service Provider.
Credit System and Evidence:
User accounts may be limited with reasonable credit limits to maintain system stability. Credits exceeding limits may be automatically deleted or transferred. The user waives any right to claim compensation due to these systemic limitations.
In any dispute, the Service Provider's server logs are primary, definitive and binding evidence.
3. AI OUTPUTS AND TECHNICAL DISCLAIMER
The Service is provided using third-party AI API providers and is provided "AS IS" and "AS AVAILABLE."
The Service Provider makes no express or implied warranties regarding the accuracy, realism, anatomical perfection, commercial quality, fitness for a particular purpose or any other quality of outputs (to the maximum extent permitted by applicable law, all implied warranties are disclaimed).
You explicitly acknowledge that artificial intelligence may produce hallucinated, erroneous, unpredictable or corrupted results. These situations are not deemed "service defects" and give rise to no rights. The Service Provider cannot be held responsible in any way for interruptions, model changes or service downtime from third-party API providers.
4. INTELLECTUAL PROPERTY, USER CONTENT AND LICENSE
Upload Declaration and Indemnification:
You expressly declare and warrant that you own the copyright or legal usage rights for every visual you upload to Nothron. You agree to completely indemnify, defend, cover legal costs and hold harmless the Service Provider against any third-party claims (copyright, personality rights, privacy, trademark, etc.) arising from your uploads.
User License:
You grant us a worldwide, royalty-free, transferable, sublicensable, perpetual and irrevocable license to use your uploaded inputs and generated outputs in anonymized form for system optimization, model training, debugging and legal compliance purposes.
Output Ownership:
Generated outputs belong to you to the maximum extent permitted by applicable law. However, due to the nature of generative AI, results may be similar or identical to other users' outputs. Nothron does not guarantee that outputs will be 100% unique or suitable for trademark/registration. We recommend consulting your own legal counsel before using outputs for commercial or legal purposes.
The Service Provider claims no ownership over inputs and outputs; only retains the license above.
5. PROHIBITED ACTIVITIES AND ACCOUNT TERMINATION
The following acts will result in immediate and permanent account closure, deletion of credits and no refund:
• Reverse engineering, API scraping, bot, script or automation tools to abuse the service
• Manipulating the credit system or overloading service capacity
• Processing illegal, violent, hate speech, copyright infringing or third-party rights violating content
• Using the service for competing product development, AI model training or commercial competition purposes
The Service Provider has the right to conduct automatic and manual reviews to detect violations.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law:
• The Service Provider's total liability for any direct claim is limited to the total amount paid by the user in the 12 months prior to the claim or 100 USD (whichever is lower).
• Under no circumstances shall we be liable for loss of profit, data loss, reputation damage, indirect, incidental, special or punitive damages.
• This limitation applies to all claims based on contract, tort, negligence or any other legal theory.
7. PRIVACY AND PERSONAL DATA (GDPR)
The processing of your personal data is subject to a separate Privacy Policy and is an integral part of this Agreement. Please read the Privacy Policy carefully.
Important: Visuals uploaded to Nothron are never permanently stored on our servers at any stage. Visuals are processed only temporarily during the enhancement process. After the process is completed and successfully downloaded by the user, or when the page is closed, they are permanently deleted. No visual is stored long-term except for system backups or temporary processing buffers.
Your data is processed only temporarily for instant delivery of the Service and may be shared with third-party AI API providers. You are deemed to have given your explicit consent under GDPR.
8. PAYMENT AND THIRD-PARTY SERVICES
Payments are received via Lemon Squeezy. Lemon Squeezy's Terms of Service and related policies also apply. By accepting this Agreement, you also accept Lemon Squeezy's terms.
All logins are done via Google Sign-In. Google's OAuth and authentication policies also apply.
9. GENERAL PROVISIONS
Force Majeure: We are not responsible for earthquakes, floods, wars, terrorism, government restrictions, third-party API interruptions or events beyond our control.
Changes: These Terms may be altered with prior notice on the site. Continued use means acceptance of the new terms.
Account Non-Transferability: Accounts cannot be transferred or sold.
Severability and Waiver: If a provision is invalid, the remaining provisions remain in effect. Non-exercise of a right does not mean waiver of that right.
Entire Agreement: This Agreement is the complete and final agreement between the parties on the subject.
10. APPLICABLE LAW AND JURISDICTION
This Agreement is subject to the laws of the Republic of Turkey.
For the resolution of any dispute arising from this Agreement, the ANKARA COURTS AND ENFORCEMENT OFFICES have exclusive jurisdiction. The parties waive the right to object to other jurisdictions. Mandatory provisions of local consumer protection laws for international users are reserved.
